Form 5 — Declaration as to Inventorship
Form 5 formally declares who the true and first inventors of the invention are.
What Form 5 is for
Form 5 answers a simple question with long consequences: who invented this? Indian patent law separates two ideas that people often merge. Inventorship is about who actually devised the invention, and only natural persons can be inventors. Ownership is about who holds the right to apply, which is often a company. Form 5 records the first of those two, and it is filed where a complete specification accompanies the application.
The declaration is made by the applicant, and it states that the persons named are the true and first inventors of the invention claimed. Where the applicant is not the inventor, the declaration supports the chain that lets the applicant apply at all. Section 10 requires a declaration of inventorship with a complete specification, and Rule 13 sets out how it is furnished.
The effect of getting this wrong is not cosmetic. A wrongly named inventor, or an omitted one, can be corrected later through the separate route that deals with the mention of an inventor, but the correction takes a request, evidence and time. Worse, a patent obtained by someone who wrongfully obtained the invention from the true inventor can be challenged. Who files it, and when
The applicant makes the declaration, and where there are several applicants they all do. In practice it is signed by the applicant or by a duly authorised person, and an agent may file it. The inventors named are the individuals who contributed to the conception of the invention. Providing funding, managing a project or building a prototype to someone else's instructions does not by itself make a person an inventor.
It is filed with the complete specification. Where a complete specification follows an earlier provisional filing, the declaration accompanies the complete specification rather than the provisional one. Where a complete specification is filed late in the process, or where the office allows the declaration to be furnished within a short further period, the current text of Rule 13 governs how long is available. Because the period allowed has been changed by amendment, check the current Rule instead of assuming a number.
How it is filed
- Identify every person who contributed to the conception of the invention as claimed, and check that list against the laboratory or design records.
- Confirm the ownership position separately, so that assignments from inventors to the applicant are in place.
- Download the current Form 5 and complete it with the inventors' names and the applicant's details.
- Have it signed by the applicant or an authorised signatory, and by the inventors where the current form calls for their signature.
- File it with the complete specification through the e-filing portal.
- Keep the signed original and the supporting records, because entitlement questions can arise years later.

- A declaration that the persons named are the true and first inventors of the invention claimed.
- The applicant's details and the capacity in which the declaration is made.

Common mistakes with Form 5
- Adding senior colleagues or supervisors who did not contribute to the conception of the invention, as a matter of courtesy. Inventorship is a question of fact, not of hierarchy.
- Leaving out a junior researcher or a contractor who solved the key technical problem, which can lead to a dispute about entitlement.
- Naming the company as an inventor. A company can own a patent but cannot invent.
- Copying the inventor list from a related foreign filing without checking it against the claims actually filed in India, since a change of claims can change who contributed.
- Filing the declaration without any assignment in place, so the applicant's right to apply rests on nothing recorded.
What happens if it goes wrong
If the declaration is not filed with the complete specification, the office raises a requirement and the application does not move forward until it is met, with the risk of abandonment if the requirement is ignored. If the declaration names the wrong people, the error can be corrected only by a separate request supported by evidence, and it can also surface as an entitlement dispute. Where an invention was wrongfully obtained from the true inventor, the law provides routes to challenge the patent and, in some cases, to grant the patent to the true inventor instead.
An omitted inventor at a Bengaluru research group
This is a simplified illustration. A research group at a Bengaluru institute develops a catalyst coating process. The project head, Dr Vasanthi Menon, and a postdoctoral researcher, Imran Qureshi, are named as inventors on the declaration filed with the complete specification. A doctoral student, Kavya Nair, had proposed the specific two-stage annealing step that the main claim depends on, but she had left the institute and was not consulted. A year later, reading the published application, she raises the omission. The institute reviews its laboratory notebooks, confirms her contribution and files a request to have her mentioned as an inventor, supported by the records and by statements from the other two inventors. The correction succeeds, but it costs time and creates an awkward record. A short inventorship review against the claims, done before filing, would have caught it.

Questions about Form 5
Who counts as an inventor under Indian patent law?
An inventor is a natural person who contributed to the conception of the invention as claimed. The test is contribution to the inventive idea, not effort or seniority. Someone who suggested the problem, provided funding, managed the team or built a prototype exactly as instructed is generally not an inventor. Someone who devised the feature that the claims rely on generally is. Because the claims define the invention, the inventor list should be checked against the claims rather than against the project as a whole.
Can a company be named as an inventor?
No. Only natural persons invent. A company appears on the application as the applicant, which is the ownership role, usually because the inventors assigned their rights to it or because they invented in the course of employment under terms that vest the rights in the employer. Form 5 records inventorship, so it names individuals. The application form records who is applying, and that is where the company appears. Keeping the two roles separate avoids a very common filing objection.
What if we discover later that the inventor list is wrong?
There is a route to correct it. A request can be made for a person to be mentioned as an inventor, or for a name to be removed, and it may be made during prosecution or after grant. The Controller decides on the material put forward, and evidence such as laboratory records, design files and statements from the other inventors carries weight. Correction is possible but it is not automatic, and a contested inventorship dispute can hold up commercial plans, so accuracy at the filing stage is far cheaper.
Do all inventors have to sign the declaration?
The declaration is made by the applicant, and the signature requirements are set out in the current version of the form and in the Rules, which have been amended over time. Rather than assume, download the current Form 5 from the Indian Patent Office and follow what it requires. In practice it is good discipline to have the inventors confirm the list in writing even where their signature is not strictly required, because that confirmation is the evidence you will want if entitlement is questioned later.
