Patent Office forms, one page each

Every Patent Office form in everyday use, with its own page: what it does, who files it, when it is due, the rule that prescribes it, and the mistakes that get it objected to. Forms are prescribed in the Second Schedule to the Patents Rules and are amended from time to time — always download the current version from the Patent Office before filing.

Form 1

Application for the Grant of a Patent in India

Form 1 is the request that starts a patent application in India and records who is applying and on what basis.

Form 2

Provisional or Complete Specification

Form 2 is the cover sheet that carries the written description of the invention, either provisional or complete.

Form 3

Statement and Undertaking About Corresponding Foreign Applications

Form 3 tells the Indian Patent Office about applications filed abroad for the same invention and promises to keep that information current.

Form 4

Request for Extension of Time or Condonation of Delay

Form 4 asks the Controller for more time to do something, or to excuse a delay that has already happened.

Form 5

Declaration as to Inventorship

Form 5 formally declares who the true and first inventors of the invention are.

Form 6

Claim or Request Regarding a Change in the Applicant

Form 6 asks the Controller to substitute or add an applicant for a pending patent application after a transfer of rights.

Form 7

Notice of Post-Grant Opposition

Form 7 begins a post-grant opposition against a patent that has already been granted.

Form 7A

Representation for Pre-Grant Opposition

Form 7A lets any person ask the Controller not to grant a published patent application, on stated grounds.

Form 8

Request or Claim Regarding the Mention of an Inventor

Form 8 asks the Controller to name a person as an inventor in a patent or application, or to decide a claim about that mention.

Form 9

Request for Early Publication

Form 9 asks the Patent Office to publish an application sooner than the ordinary 18-month point.

Form 13

Application for Amendment of an Application, Specification or Document

Form 13 asks the Controller for permission to amend an application, a specification or a related document.

Form 14

Notice of Opposition to Amendment, Restoration, Surrender or Compulsory Licence

Form 14 lets an interested person object when a patentee or applicant asks for an amendment, restoration, surrender or compulsory licence.

Form 15

Application for Restoration of a Lapsed Patent

Form 15 asks the Controller to restore a patent that ceased because a renewal fee was not paid in time.

Form 16

Application to Register Title or an Interest in a Patent

Form 16 asks the Controller to enter an assignment, licence or other interest in a granted patent on the register.

Form 17

Application for a Compulsory Licence

Form 17 asks the Controller to grant a licence under someone else's patent without the patentee's agreement.

Form 18

Request for Examination of a Patent Application

Form 18 asks the Patent Office to examine an application, without which the application is never examined at all.

Form 18A

Request for Expedited Examination of a Patent Application

Form 18A asks for an application to be examined out of turn, where the applicant falls within an eligible category.

Form 19

Application for Revocation of a Patent for Non-Working

Form 19 asks the Controller to revoke a patent that has still not been worked in India after a compulsory licence was granted.

Form 22

Application for Registration as a Patent Agent

Form 22 is the application by which a qualified person asks to be registered as a patent agent in India.

Form 25

Request for Permission to Apply for a Patent Outside India

Form 25 asks the Controller for written permission before a resident of India files a patent application abroad.

Form 26

Authorisation of a Patent Agent

Form 26 is the document by which an applicant authorises a patent agent to act on their behalf before the Patent Office.

Form 27

Statement Regarding the Working of a Patented Invention in India

Form 27 tells the Patent Office whether and how a granted patent has been worked commercially in India.

Form 28

Evidence to Claim the Status of a Startup or Small Entity

Form 28 is the evidence an applicant files to claim startup or small entity status for the purpose of fees.

Form 29

Request for Withdrawal of a Patent Application

Form 29 asks the Patent Office to withdraw a pending application before a patent is granted.

Form 30

Request or Application for Which No Other Form Is Prescribed

Form 30 is the catch-all form for any request to the Patent Office that no other prescribed form covers.
