Patent Office forms and how Indian patent fees work

Forms are prescribed in the Second Schedule to the Patents Rules, 2003 and official fees in the First Schedule. Both are amended from time to time, so we describe how they work and link to the official versions rather than reproducing figures that go stale.

How Indian patent fees are structured

Who you are changes the fee

Official fees are tiered. Natural persons, startups, small entities and educational institutions pay in a reduced category; everyone else pays the standard rate. Eligibility must be evidenced, and transferring an application out of a concessional category triggers a payment of the difference.

How you file changes the fee

Electronic filing is cheaper than physical filing. For most applicants there is no good reason to file physically.

Official fees are not the whole cost

Official fees go to the Patent Office. Professional fees for searching, drafting, prosecution and hearings are separate. A responsible quote separates the two and does not bundle them into one number.

Why we do not publish rupee figures. Fee schedules change by notification and vary by applicant category, number of claims, number of pages, priority documents and mode of filing. Publishing a number that is right today and wrong in six months would do more harm than good. Use the official fee page, or ask us for a written estimate for your specific filing.
