What this rule requires, step by step
A correction is only useful if the world can see it. Rule 125 closes the loop opened by Rule 122. Once the Controller allows a correction under section 78, the correction is notified, so that the official record and the published documents reflect what the document now says rather than what it used to say.
Notification does several things at once. The relevant entry or document held by the office is corrected. Where the correction touches something recorded in the register of patents kept under section 67, the register entry is brought in line. Where the corrected document has already been published, the fact of the correction is announced in the Official Journal, so that anyone who downloaded the earlier version has a way of learning that it has changed.
This matters because third parties act on published patent documents. A competitor deciding whether to launch a product, a licensee valuing a portfolio, an investor running diligence and a court hearing an infringement suit all work from the public record. If corrections were made privately, that record could not be trusted. The date of notification also tells everyone when the corrected version came into the public domain, which can matter when someone says they relied on the earlier text.
For the applicant or patentee, notification is the point at which the job is finished. Until the correction is notified, certified copies obtained from the office and the online file will still show the old text. It is worth downloading the corrected document after notification, checking it says exactly what was allowed, and circulating the corrected version internally and to foreign counsel where the same error appears in corresponding applications elsewhere.
Occasionally the notified correction does not match what was asked for, usually because of a transcription slip at the office end. That is itself a clerical error, and the sensible response is to raise it with the office promptly rather than to live with a record that is still wrong.

How it works in practice
Checking the record after the correction
Zarina Qureshi manages the patent portfolio of a Nashik agricultural equipment maker. A granted patent recorded the priority application number of the company's earlier Indian filing with two digits transposed. She applied for correction under section 78, the Controller allowed it, and the correction was notified. Zarina did not stop there. She downloaded the corrected document from the online file the following week and compared it, character by character, against what had been allowed. The claim text and the description were right, but the corrected number appeared correctly in one place and in its old form in a second place further down. She wrote to the office pointing out the remaining slip, with a copy of the order allowing the correction, and the second occurrence was fixed. Because the company was then in the middle of a licensing discussion, the licensee's diligence team was given the corrected document together with the journal reference showing when the correction was notified.

How do I know a patent correction has actually been made?
Look for the notification. Once the Controller allows a correction under section 78, it is notified under Rule 125, the office record is amended, and where the document was already published the correction is announced in the Official Journal. Check the online file for the patent or application and download the current version of the document. If the file still shows the old text some time after the order allowing the correction, take it up with the appropriate office rather than assuming it will catch up on its own.
Does a correction change the rights under the patent?
A clerical correction is meant to make the document say what it always meant to say, so in principle it does not change the substance of the monopoly. That is exactly why the Controller refuses corrections that would broaden a claim or add new matter. What the correction does change is the text that everyone will read and rely on going forward, and the date of notification tells third parties when the corrected version became public. Anything more than a slip has to go through the amendment route instead.
Do I need to tell anyone else once a correction is notified?
It is good practice. Send the corrected document to licensees, to any party in a pending dispute, and to foreign counsel if the same error appears in corresponding applications abroad, because a correction in India does not fix an equivalent mistake in another country. Update your internal portfolio records and any due diligence pack that quotes the old text. If certified copies of the uncorrected document are in circulation, replace them with copies obtained after notification.
