Specifications, claims and disclosure

The specification is the bargain: you disclose fully, and in return you get a monopoly limited to what you claimed.

A provisional specification lets you fix a date while the invention is still developing. A complete specification must describe the invention fully, disclose the best method known to the applicant, and end with claims that define the scope of protection.

Claims are where value lives. Too broad and the claim reads onto the prior art and falls; too narrow and a competitor designs around it in an afternoon. Indian practice also requires the claims to be supported by, and fairly based on, the description.

Insufficiency of disclosure and lack of clarity are independent grounds of revocation. A specification written to hide the good part usually fails both the disclosure requirement and the commercial purpose.
