Patent agents and who may act
Who can file, argue and sign for an applicant before the Indian Patent Office.
The Act maintains a register of patent agents and prescribes qualifications and a qualifying examination. Only registered agents — and in specified circumstances, advocates — may act in the ways the Act reserves.
An agent's authority comes from an authorisation filed on the prescribed form. Without it, the Office will not deal with the person purporting to act.
Names can be removed from the register and later restored, and the Controller has power to refuse to recognise particular persons.
